Dismissals

Operational Requirements

This ground for dismissal is used when the employer’s operational needs so require, and is commonly known as retrenchment. (Section 189 of the Labour Relations Act)

 

Incapacity

An employee can be dismissed if he is incapable of working due to ill health or injury, which will result in dismissal on the grounds of incapacity. (Section 188 of the Labour Relations Act)

 

Misconduct 

Misconduct is the broadest ground for dismissal, ranging from dismissal for insubordination to theft and gross negligence.

(Section 188 of the Labour Relations Act)
